Terms of Service

gradely is designed for use by teachers and education professionals to assist in writing student report comments. You may only use the Service for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to reverse engineer, scrape, or extract the underlying models or prompts
• Use automated means to access the Service beyond normal usage
• Share your account credentials with others
• Use the Service to generate content that is defamatory, discriminatory, or harmful

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at hello@gradely.au if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

gradely offers a free plan and paid plans. Paid plans are charged as one-time payments per 90-day billing window via Stripe. All prices are in Australian dollars (AUD) and include GST where applicable.

Credits: Each plan includes a set number of comment generation outputs. Credits reset at the start of each 90-day window. Unused credits do not carry over. Top-up credits expire at the end of the current billing window.

Refunds: Because outputs are consumed immediately upon generation, we do not offer refunds for used credits. If you experience a technical fault that prevents generation, contact us and we will assess the situation on a case-by-case basis.

Price changes: We reserve the right to change pricing. Existing plan holders will be notified by email before any price change affects their next billing cycle.

gradely uses AI to generate report comment drafts. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing, editing, and approving any comment before it is used in an official report
• gradely is a drafting aid, not a replacement for professional teacher judgment
• You own the final edited content you publish; we make no claim over it

The gradely platform, including its design, code, and branding, is owned by us and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written permission.

The comment text you generate using your own input data belongs to you once generated.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose.

To the maximum extent permitted by Australian law, gradely shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to errors in AI-generated content used in student reports.

Our total liability to you for any claim shall not exceed the amount you paid to us in the 90-day period preceding the claim.

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of gradely after changes are posted constitutes acceptance of the updated Terms.
